Does Your Window Replacement Need a Permit?

It is common for homeowners to get confused about whether a permit is required for window replacements since some home improvement projects require one while others don’t. Does Window Replacement Require a Permit?

Unless you’re only replacing the sashes, you will need a building permit for your window replacement. A permit is usually required if you’re replacing the entire window. It must also be obtained for any horizontal enlargement, no matter how minor. If you’re switching to a different window style — for instance, changing from double-hung windows to casement windows — then you’ll likely need a permit. In these projects, a permit is required since cutting the studs on either side of the window could cause the wall structure to become unstable. 

Who Is Responsible for the Permit?

Permits must be obtained by the homeowner. They are the ones who submit the application, pay the fees and ensure that the permit is granted before any work begins. However, it is frequently difficult for homeowners to know exactly what to put in the permit application or how to fill it out correctly. As a result, many homeowners simply expect or rely on the replacement window contractor to do the work for them. While there is nothing wrong with relying on a trusted window contractor, it also helps to have a good understanding of the process of getting a permit.

If you don’t have a permit, you won’t know if your new windows are code-compliant. As a safety precaution, the building code requires tempered glass in any windows near doors, near the floor, or in tubs or showers. Tempered glass is stronger than regular glass and shatters instead of breaking into sharp shards, reducing the risk of injury. Failure to secure a permit can also cause problems if you decide to sell your house.
